A closed damper is not a seal

A throat damper is a metal plate that closes against a metal frame, and even a good one does not seal tightly. Years of heat and moisture warp the plate, rust the frame and loosen the handle, and gaps open along the edges. Smaller animals squeeze through, and bigger ones settle on the ledge right above the plate.

During an animal job the damper is treated as a partial barrier, and the fireplace opening is covered as well until the flue is clear. If the damper cannot close at all, its repair is priced separately. A damper that is beyond saving can give way to a top-sealing damper mounted on the flue itself.

What the swift rule means in practice

Federal law covers chimney swifts through the Migratory Bird Treaty Act. In the Fish and Wildlife Service's words, it is illegal to harass, injure or kill the birds, and the protection extends to their eggs and nests.

For a chimney, that turns into three working rules. An active nest is not removed. The flue is not capped or blocked while swifts are using it. The sweep and the cap are scheduled after the birds have migrated.

Nests, sparks and blocked draft

A nest in a chimney is a bundle of kindling sitting in a flue built to carry flame and hot gas. Sparks from the first fire of the season can light it, and a burning nest in a narrow flue burns hot. Even unlit, a nest across the flue or packed on the smoke shelf narrows the passage and can turn smoke back into the room.

Removing nest material is therefore a safety step first. After it comes out, the flue is swept and checked along its length, because nests are built in layers and debris can lodge well above the part visible from the firebox.
